The Mbabane High Court in eSwatini has dismissed the state's application to declare the Ndimande brothers' late appeal against their extradition order invalid.
Siyabonga and Malusi Ndimande were arrested earlier this year in Mbabane for their alleged involvement in the murder of rapper Kiernan "AKA" Forbes and his chef friend Tebello Motsoane in Durban in February last year. Their defense team is opposing the extradition order that was granted by the Manzini Magistrates Court in August, which seeks to bring them back to South Africa.
The Mbabane High Court ruled that the appeal had been filed within the specified time frame, allowing the process to continue. The case has been postponed for the submission of the appeal grounds by the defense, after which the next court sitting will be determined.
