Pinging Doesnt Link Modack To Kinnears Murder: Lawyer
The lawyer representing alleged Cape Town underworld figure, Nafiz Modack, has argued there is no evidence connecting the pinging of Lieutenant Colonel Charl Kinnears cell phone to his murder.
Modack, who faces over 100 charges including Kinnears 2018 murder, will appear in the Western Cape High Court today as part of an application to have the charges dropped.
Kinnear, a top Anti-Gang Unit detective, was killed outside his home in September 2018 while investigating Modack.
Advocate Mohamed Bashierudin-Sibda said: "If the pinging occurred as it did and the shooter is completely oblivious to it, it doesnt play a role in Kinnear. And it was a well-known concession that there is no proof, no direct link as we also know that there are various possibilities that arise. The shooter could have relied on his own physical observation. We dont know how long he was lurking in the street."
The trial continues in the Western Cape High Court.
