The uMkhonto weSizwe Party MK Party says its disappointed the High Court in Johannesburg dismissed its application regarding a decision of the Judicial Service Commission JSC. The party had sought a declaratory order that the decision of the JSC to deny its request to postpone interviews scheduled to begin on Monday was unconstitutional.

However, Judge Stuart Wilson found that the decision of the JSC was rational as the body was bound by the order of the Western Cape High Court that temporarily interdicted the MK Partys Parliamentary leader, John Hlophe from participating in the JSC sitting.

MK Party Spokesperson, Nhlamulo Ndhlela, the party still believes Hlophes rights were infringed.

We still believe that Dr Hlophes rights were infringed upon, including MKs rights, and with that, we believe that the continuation of the sittings can only lead to a lot of controversy and potential legal battles going forward regarding whom and what process. In this case, we believe wouldnt be democratic to selecting the judges as it ought to be selecting them without infringing on participants rights. But that being the case, we are reviewing the judgment and we will take a decision from a legal and political position as to what goes next, he says.
