Dr Nandipha Magudumanas legal representative, Advocate Anton Katz, has argued that his client was unlawfully arrested in Tanzania as South African authorities failed to wait for the extradition process.
Magudumana is seeking a declaration order from the Supreme Court of Appeal that her arrest was unlawful.
Advocate Katz questioned on what basis the police and the Home Affairs Department officials travelled to Tanzania if they were not there to arrest her.
He contended that police power ends at the border, so they had no business being in Tanzania in April 2023.
Katz emphasized that if Magudumana was deported, there wouldnt be a need for the two countries to have an agreement, instead Tanzania would have just deported her.
