Freedom Under Law (FUL) has described the attitude of MK Party member John Hlophe as an indication of the undermining the rule of law and the Constitution.

This emerged after Advocate Dali Mpofu, who is representing Hlophe and the MK Party, told the court that the case in the Western Cape High Court by the DA and others against Hlophe should be thrown in the dustbin because it is not about the rule of law.

The applicants want the court to review and set aside the decision the National Assembly had taken to designate Hlophe to the Judicial Service Commission (JSC) .

Advocate Wim Trengove was representing the FUL in court.

And I would like to quote him that you should throw in the dustbin. You have a litigant before who says that the rule of law is worthless that you should throw it to the dustbin. Well, section (1)3 of the Constitution says that the founding values of the Constitution includes the supremacy function of the rule of law. So it is not open to the litigant to urge you to throw the rule of law to the dustbin, explains Trengove.
