Duduzile Zuma-sambudla To Sue The Npa For 'malicious Prosecution'
uMkhonto weSizwe MK Party member of Parliament Duduzile Zuma-Sambudla has instructed her lawyers to take legal action against the National Prosecuting Authority NPA for malicious prosecution.
Zuma-Sambudla appeared at the Durban magistrates court on Thursday 30 September. She is facing charges of terrorism, inciting public violence and inciting malicious damage to property. The charges are related to her alleged social media posts during the July 2021 unrest.
Duduzile threatens legal action against NPAIn her bail application, she claimed the charges are politically motivated. I also hold the strong view that the charges are malicious and politically motivated, her lawyer, Advocate Dali Mpofu, said while reading her submission.
They are aimed at settling political scores with my father by the current regime. Evidence in this regard will be led during the trial.
Suffice to say at this stage that Im confident that a case of malicious prosecution will be well and easily established against the NPA at the appropriate stage. I have instructed my legal representatives to pursue that action.
Zuma-Sambudla is the daughter of former President Jacob Zuma , who was incarcerated in July 2021 after being found guilty of contempt of court by the Constitutional Court . The unrest erupted soon after his imprisonment.
Prima facie evidenceMeanwhile, the state prosecutor said the NPA has prima facie evidence implicating Zuma-Sambudla.
We have secured evidence, through investigation, that supports the allegation that she, unlawfully and intentionally, by publishing those words, committed the crime of inciting public violence, he said, adding that the investigation is complete, and the state is ready to serve the indictment.
She was released on a warning, and the matter was transferred to the Durban high court for a pre-trial or trial hearing on 20 March 2025 at 08h30.
